The Age of Consent for the LGBT Community

Regardless of sexual orientation, the age of consent for sexual activity is the same in India. Regardless of whether a person is in a heterosexual or same-sex relationship, the age of consent(LGBTQ+ rights) is 18 years old.

Although Section 377 of the Indian Criminal Code, which criminalised gay behaviour, was overturned by the Indian Supreme Court in 2018, discrimination against the LGBTQ+ population continues to exist in many areas of the nation. Members of the LGBTQ+ community may experience social stigma, harassment, and discrimination in various facets of their lives because same-sex marriage is not currently accepted in India.

However, there are also organizations and activists working to promote LGBTQ+ rights and support the community in India, and there have been some positive developments in recent years. For example, some states have recognized transgender people as a “third gender” and introduced policies to protect their rights. Nonetheless, there is still much work to be done to ensure equality and protection for all individuals, regardless of their sexual orientation or gender identity.
